Food reseller FBA inventory marked as defective

The news stories interchange $5b and $5m

It’s 5M for sure, the more credible sites all say M, and also given that this is a false advertising case, the damages would be loosely limited to the aggregate purchase price of the products (plus attorneys costs), and 5M fits a lot better than 5B there.

Or Hershey could have just asked me to take a bite out of each candy bar before they were packaged.

Just sayin …

It’s not the bite they’re suing over, it’s the little design in it, which you would reasonably expect to match the packaging, and is something that people wouldn’t be too happy about if they wanted to make a platter out of it or something.

They are suing because what is shown on the package is not what is in the package.

The bite is CLEARLY shown. Just sayin!

We have no way of knowing what their 50+ (Amazon-only) customer complaints have been.

And companies’ failing to accurately and completely delineate ingredients and provide warnings have caused more than just “complaints”. Just one recent example:

Ok … will provide the bite and my artistic skills …

… anything more than that, Hershey will have to negotiate with me … I can’t just be giving my talents away …

Just saying …

In my experience there typically is not an expiration date on items not labeled for individual sale.

On the individual candy pieces, like the jolly ranchers, definitely not. I can’t remember ever seeing a mini bag of chips that didn’t have a date printed on them though. Could be wrong.

One of my favorite scenes from one of my favorite movies (The Jerk). “Pay to the order of Joe Smith - One dollar and 9 cents!”
