Need some Help IP complaint that really went sideways.

Depending on your core values, as well as your view on the manufacturers legal capacity or lack of understanding of how Amazon works, perhaps re-branding/re-packaging the product for sale under a brand listing you have control over will help you clear out this inventory and get your capital back.

Seems you are not alone, in fact this thread indicates it’s a much larger issue involving 31 listings.

https://sellercentral.amazon.com/seller-forums/discussions/t/353ccf45-113f-4165-bc53-a22f6d6affef

Anyway, TCR informs us that it is bigger than our 2 ASINs. Apparently, ours was 2 of 31 listings of FALSE IP complaints, supposed submitted by TCR, but they weren’t. Yet, Amazon ignores everybody, including TCR, the supposed complaint filer, that didn’t file the complaints.

Hope this helps in some way.

One would think that TCR would file a complaint with Amazon about ā€œabuseā€ by the person misrepresentation himself as a rightsholder for their brand.

One would think that but Amazon isn’t logical and robots can’t think, regardless of what NVIDIA tells us.

This is a very simple issue that anyone with 30-50 brain cells could have figured out but nobody is actually looking at this stuff.

That’s where this comes in :arrow_heading_down:

Humans get involved under escalation and will realize (if the OP gets someone decent), that what Amazon is looking for is impossible because the initial complaint was fake news.

Yepper - the available evidence suggests that that’s exactly how the infamous Q1/2019 Franklin Covey Co. false-flagging (link, NSFE v. of original OSFE thread) was - for once - quickly resolved.

Unfortunately, as was the case in that situation (and many another), it is not particularly uncommon for a carefully-couched C&D dispatched to the OGC via Certified Mail directly from the Rights Owner’s legal representation being required in order to break the logjam.

Given the multiple entities involved in the troubling Amabots Gone Rogue situation which our friend @Thelunatick has brought to the fore, here, compounded by the siloed nature of Amazon’s Byzantinely-intricate bureaucratic infrastructure, it may well take an excessively inordinate amount of time for all of the ducks to line up neatly in rows.

How’s that warm embrace of generative AI working out fer ya, Andy?

To be fair, it must be admitted that the whiz kids didn’t consult me in coining that terminology.

Likely because they knew that if they had, I’d’ve immediately trotted the whole damnable concept out to the Back 40 and plowed it under…

TY to all and @oneida_books I never had to submit the reformatted letter but I appreciate the advice.

Yes I double checked and the hit is gone from my account health page.

They have and it has fallen on deaf ears. TCR has apparently been threatened with lawsuits from the other sellers.
The guy told me there are over 30 different sellers that have the complaint.

Love it when the good guys win one.

Congrats!

May I ask if you have any indication from TCR that this matter has now been entirely cleaned up?

I did not hear from TCR but heard from Composite Resources. They had one bad actor on the listing and tried to get them removed. It resulted in everyone else getting removed.

Somehow Amazon accepted my appeal before Composite Resources was able to clear it up.
