Something’s gotta give here. They have tons of items in their warehouses already that are NOT compliant according to Amazon’s (premature) enforcement. Some points:
1.) The law applies to items manufactured or imported after March 19, 2023.
2.) The law doesn’t go into effect until September 2024.
Many sellers are getting different deadlines…one seller has a week. I have about 25 days now on my flagged items.
Hopefully, they won’t actually suppress listings until the September 2024 enforcement deadline.
Your original INR Appeal template has pulled our fat out of the fire many times - as is undoubtedly true for many other members of the 3P Seller Community, hence its wide fame; your explanation of the 2016 re-labeling fiasco you endured has kept us on our toes, as that was the first time I realized that such a possibility not only existed, but was in fact all-too common an occurrence.
You were also among the first of the vets I saw to mention the efficacy of a well-formulated packing slip for FBA Inbound Shipments - a practice that Amazon itself eventually embraced in published policy.
There are many seasoned and savvy forum veterans whom I’ve had reason to admire for their contributions, and I sincerely doubt that I’m the only one who thinks you’re one of the best and brightest of them.
I remember you more clearly now. I wasn’t paying as much attention to the old forums once I got banned for 1,000 years because of she-who-shall-not-be-named.
Anyway, I am caught up in the UL 4200A mess and wanted to share some info in case anyone is interested:
I do not have test data for my button cell items. They were manufactured and imported last year before the restriction applied (March 19, 2024). None of my suppliers have any clue what I am talking about when asking if they have the new testing certification (4200A), or a children’s safety certficate (my items are not considered a toy, but I thought they might have the certification anyway, as they have a few EU certifications showing right on their product description page).
Amazon is slowly going through my listings for these items and converting them to dog pages.
However, I believe they don’t care about self-fulfilled items. Once you select “I will ship this item myself”, the battery info requests disappear from the safety/compliance tab. They don’t care what you are shipping as long as they won’t be held responsible.
As for the flagged listings, you can’t simply delete the FBA offer and recall your merchandise and continue on the same ASIN with FBM offers only. Once it’s been flagged, you have to provide the test data to resurrect the listing.
Therefore, as my listings are suppressed/deleted, I am recreating them as self-fulfilled only, being sure to select 'I will ship this item myself" first so that the compliance tab morphs into one that doesn’t care about the battery info. Luckily for my situation, I have UPC exemption and a registered brand, so I won’t get hung up on matching UPCs with my deleted branded products.
Yes, I lose all the reviews/rankings, etc. Yes Amazon sucks, effective immediately.
