Interesting. And About dang time.

They worded the agreement wrong.

They should’ve used the same policy they have with sellers. That sellers must offer a price on Amazon that’s equal to or better than the price they offer off Amazon. (Does that policy still exist?)

If they stated that the suppliers must offer Amazon a price so that they can offer pricing that’s equal to or better than non-Amazon retailers then it wouldn’t reek of price fixing.

The Price Parity Clause (“S-4 Parity with Your Sales Channels.”) of the ASBSA was removed from that contract’s verbiage on 11Mar2019, evidently in response to broadsides launched across Amazon’s bow by certain political figures who are prominently powerful.

Not willing to be undone, Amazon introduced the Fair Pricing Initiative, which over the last 4½ years has by and large produced the same effect - hence the domestic & foreign regulatory bodies looking askance yet again on the practice…
