What is counterfeit to Amazon?

another issue is test buy, if the item has not been delivered Amazon does not consider it for complaints, trademark or product not as described

Vendor central means they sell to Amazon who sells it as a 1P (their offer shows up as sold by Amazon.com).

Does not explain why the same vendor got slapped for previous infringement and it went through for a different variation.

Since the seller I am talking about doesn’t ship me the item but confirms it, I have reported thru amazon on report abuse but they haven’t taken action, even though other people have been suspended by this

here is a individual who did this and got his account suspended

impossible for me because seller wont ship to me, will ship to friends amazon account but not mine

Then simply destroy them with metrics and keep ordering till they are closed. That is a guarantee as Amazon does not play with late shipments and INR. We love sellers that do that.

cant, 1. high volume seller around 20-30k plus order monthly 2.he confirms shipment by providing false tracking number doesn’t hurt his account

Chargebacks and INR add up even at 20k a month as it will hit their ASIN metrics. We did this to a Ukrainian seller doing the exact same thing.

Just keep doing it till they get the ASIN stripped for high refund.

but the ASIN is our brand, we have done like 100 orders nothing happened

Its a time pressure thing. Every seller/vendor has ASIN metrics and too many returns/refunds will get an ASIN suspended by that seller if they don’t hit account metrics.
Its either that or get a lawyer. I just paid a $5000 retainer for our IP lawyer to go after a competitor who has been stealing our IP for months now.

It is invariable in trademark and/or copyright litigation that the infringer makes as many accusations as possible against the rights holder, everything from claims that the IP rights were obtained via fraud, to counterclaims that the rights holder is engaging in false advertising by making claims that are false. Worse yet, if one’s claim is “baseless” or “frivolous” one can end up paying the other sides attorney fees and costs, which can dwarf any possible damages award.

The seller may also report your “abusive behavior” to Amazon, and get revenge via Amazon itself.

TL;DR, don’t make spurious accusations. Do the test buy, report “not as described”, get them off the ASIN.

what if they don’t ship lol, that my main issue as well: seller confirms shipment but doesn’t actually ship. it is a violation of policy to do this but amazon hasn’t taken action yet
