I created a product, patented it, and sold on Amazon for years. Today I wanted to create a new listing to sell on Walmart. To my surprised, a Chinese seller (I knew that he’s a Chinese seller because of the business address is in China) already created the listing of my product. He used all photos and wordings from my Amazon listing. Every piece of the product has my trademarked logo on it. Hence every photos that he used also has my logo. He cannot possibly have my product. I never wholesale to anyone. I’ve manufactured in China and ship to Amazon for years. Amazon is the only channel that has this product.
What’s the best way to report him? By clicking at the link that the red arrow pointing to (see screenshot below)? What should I report the issue as; counterfeit or trademark or something else? Please advise.
Did you set up your brand on Walmart?

In case Walmart is as helpful as Amazon, here is my standard message to sellers on the NSFE –
You may be able to contact the FTC about any organized activities if more than one or two orders are involved and ALSO the Government has a site IC3 https://www.ic3.gov/ where you can report the use of the internet for theft and fraud.
It is generally used to report on websites but it can be used to report buyers as well as other sellers if you happen to encounter one of the Amazon scam crowd.

The Chinese seller should be buying from you over at Amazon and then having you drop ship it to the buyer from Walmart. There’s actually nothing illegal about that.
One “trick” I’ve heard of is that you temporarily raise your price on Amazon. Then go to Walmart and have your “wife” or twin buy it. Your price on Amazon needs to be higher than his price on Walmart.
Costs HIM money or he has to cancel the sale.
Do a test buy – is it really your product or did he scrape all the information and sell a duplicate. Registering your brand and a test buy is what I recommend,
And then do a return and include a CEASE and DESIST letter. Maybe that will scare him off.
