Amazon Transparency Question

I am the brand owner, manufacturer, and distributor. I have no approved resellers. My brand’s trademark is registered in the U.S. only. Most of my business is in the US marketplace. I have many listings copied over to the Canadian marketplace.

I have Amazon Transparency set up for one ASIN, which is a custom product.

I have 8 other ASINs that have 1 or 2 Canadian sellers that have hopped onto these listings. I’d like to get them off these ASINs as it is my brand and U.S.trademark. Which option(s) would best meet my needs in the short term?

1st Option: I can make these custom listings (I really want to so the customer can customize the product), but I don’t know if Amazon will allow adding customization after there are already other sellers on the ASINs in the Canadian marketplace.

2nd Option: Get my trademark registered in Canada and eventually get them kicked off the ASINs. (Expensive, time consuming)

3rd Option: Register these 8 ASINs with Amazon Transparency. Would this carry over into Canada and/or other marketplaces as well?

Or - do you have any other creative ideas on how to get them off these branded product ASINs? Filing a Canadian trademark will take some time and some expense. I suppose that is the best solution long term. But while finances are tight, I was wondering if another way might be more economical and efficient.

My understanding of the transparency program (at least in the US, probably worldwide), is that the brand is required to put transparency codes on all products they produce – not just the ones sold on Amazon. So, if other sellers are getting legitimate product, transparency probably won’t be the solution you’re looking for.

I get to select which ASINs/UPCs I enroll in Transparency. But if I sell the same UPC on another channel, I have to put transparency on it.

Yes, that is the way I understand the fine print of the program. It’s meant to assure customers that they are getting an authentic item no matter where they buy the product.

That is what is supposed to happen however I have run into many products where this is not true.

Example B00008PC1O.
We have been selling this item for over a decade, now we have “Request Approval”. When you click the “Request Approval” button it brings you to the " Transparency Listing Application"

Where it asks you :Will you upload Transparency serial number codes in Seller Central or MWS API when you ship customer orders yourself via FBM/MFN? Transparency codes can be uploaded in either Seller Central or using MWS API. Serial number codes must be uploaded in Seller Central.

However, we purchase these items directly from the manufacturer and they DO NOT put transparency code on them.

I do not know how they are getting into the transparency program.

Seller support cases only go down to a dead end.

Now there is only 1 seller on the listing (he’s there with 6 offers) I’m wondering how they are pulling this off.

Going to guess that they brand registered ‘Sun In’ and then applied for the transparency program. Is the brand name actually ‘Sun In’ or is it “SunIn” or “Sun-In”?

Wow - I wonder how they are doing this??

On my ASINs, I was thinking I can do test purchases before I do transparency - and submit brand registry complaints (they won’t have our specific markings / seal of authenticity that only we make).

And then, if they haven’t jumped off the listings, I can repeat this process after I enroll the ASINs into the Transparency Program.

I was in transparency a long time ago too with some of my ASINs. I agree that you’re supposed to assign a code to your items and no matter where you sell them.

I suggest going into the Brand Registry part of Amazon and report a violation there. It’s a different log in

I did that too a long time ago and messed myself up at first because I failed to see that last drop down menu to report the other person and I was reporting the whole ASIN.

Things may have changed, and I haven’t had problems any more lately…as in years now. But now I control lots of the supply.
