[CBS News] Amazon to start posting about product safety recalls and defects after legal order

Honestly it is underhanded if Amazon actively “hid” recall info, but now that they are liable for 3rd party sellers, guess no more hiding.

Probably part of the recent rise in compliance / dangerous goods requests that we are seeing discussed on NSFE.

I always wondered how they got away with ceasing to list product recalls.

It is not a new requirement, and Amazon stopped somewhere between 2008 and 2010.

Should not affect much, Costco lists its recalls in a place that people who do not visit the restroom will not notice.

Long overdue that this occur. Brick and mortar retailers have “always” had to do this. Just because the “mall” is online shouldn’t change requirements. Obviously too many laws have never been updated for the internet age.

"Amazon has now been legally declared to be a participant in the chain of distribution of products," Fountain said. “That may not sound like much to the average person, but from a legal standpoint, that creates a huge duty on Amazon to be aware of and monitor and provide notice of safety defects and recalls to the consumer.”

I wonder if this will have other consequences for Amazon. :eyes:

So these caught my eye:

Amazon released a statement saying the company is disappointed by the Consumer Product Safety Commission’s decision and plans to appeal.

Yet:

“The remedies ordered by the CPSC are largely duplicative of the steps we took several years ago to protect customers, which are the same steps we take whenever we learn about unsafe products,” Amazon’s statement said in part.

Attorney Don Fountain says it is a significant ruling. Attorney Don Fountain is a tort lawyer. Hence Amazon will appeal this ruling even if it means no difference in how it handles recalls.

@Papy I think you know that this will have other consequences for Amazon if the CPSC ruling is allowed to stand. And they will bring out their legal big guns to fight it.

@Pepper_Thine_Angus No conflict between those two statements - voluntary steps are different from a CPSC ruling.

Minus from the fact that they are now required to publish it.

Walk into Home Depot, Recall info is right at the front door, Amazon should be no different even though they have a virtual front door.

Exactly these things.

And it seems that Amazon capitalizing on this weakness has contributed to its “success” in too many ways.

Retailers–whether b&m or online–should be on the same playing field and held to the same requirements.
