Sue what exactly, an entity that does not exist, with no physical presence, anybody can have an online presence, even someone in the Space station can have an online presence.

And if they do not represent the Brands, would that use of the brand on their website not be infringement itself?

I believe it would be. At the minimum it would be copyright infringement since they’re using their logo for a fraudulent purpose.

If the webhost is in the US they would have to respond to a DMCA takedown as well

If the scam business is effective in kicking off unauthorized Sellers with costing the brand a penny, maybe they just look the other way until it’s a problem. Scammer still gets paid by the Seller who hired them.

The actions of this company need to be reported to Amazon as “trademark abuse”, and you (as a seller) should let Amazon sort it out with the brand owner.

The claims made are fraudulent and extortionate. If you are authorized by the brand, and are buying via a legit supply chain, then any threatening letter to you is “trademark abuse”.
