Look what Walmart Allows to go on.....

This Chinese seller directly lifts the complete trade dress of countless brands in my category and just changes the brand name.

I alerted 2 executive connections about this months ago. The only thing that has happened is they have added 500 more listings. Here’s an example:

This doesn’t even make any sense. If you look at the listing it shows softgels in the bottle. Listed as capsules. Neither is fast dissolve but Walmart has no issue with this.

This is actually exponentially worse than what occurs on Amazon. They have stolen the trade dress of countless brands much bigger than Vitamatic (BS Amazon brand) and nothing has happened to them. SMH!

They haven’t gotten our brand yet but I am sure it’s coming.

I can’t tell from that picture but does their product say made in USA where they have the flag in the lower right corner? If they are that stupid, it’s an easy win with the FTC (provided they are made in China).

Does the FDA make the GMP certification? Can you report the brand to them for falsely claiming cert?

The FDA doesn’t care what scam artists do if they do not have the ability to pay. That’s just the way it is and always has been. This scam artist is located in China. The long arm of the law isn’t that long.

The moral of the story is really what Walmart is allowing here which is reprehensible and shameful when you consider the level of detail I handed to 2 individuals that matter over there.

Say what we will about Amazon but this nonsense would have been stopped perhaps before it even started there.

This has been going on since April at a minimum.

What I gather from the limited reviews available is that these people are shipping unlabeled bottles of pills when an order is placed from China.

No, GMP can (more or less) be claimed freely so long as it’s not lying. There are GMP certifying bodies, but that particular phrasing isn’t protected. Now, if it were the NSF seal, or a particular certifying body’s seal, that would be something you could report on.

To be fair, this kind of thing is also all over Amazon, but the listings don’t seem to last long. They’re usually < 1 month old when I see them.
