Registering trademark for existing brand

If you are able to make it through the USPTO trademark process (which takes on average about a year to get through), then … yes you would own that trademark brand name. If that name was not previously registered in brand registry, then … the you could get the trademark name brand into the brand registry. If the brand name was previously in brand registry, it will require more effort on your part to get the ownership into your name with brand registry. Just recognize that ownership of the trademark brand name and being in Amazon Brand Registry are two different animals to tame.

Is the listing a generic listing? If the original owner did a listing that was generic, you will not be taking over the listing. You will need to create a new listing with the newly acquired trademark brand name.

It sounds like you will more than likely have to create a new listing to associate a trademark brand name with it. You will be starting new. Because of that, it might be better to start with a fresh new trademark brand name.

If you were able to assume the current listing that was under the brand name which you would now own the trademark rights, what would you do with the other sellers who have been selling on the listing generically? It could get messy and costly. It could also come with past baggage that you could inherit by the name association.
