Trademark violation with no trademark mentioned and no complainant contact.

Didn’t even get an e-mail
just saw it on account health.

Submitted the LOA from the manufacturer, instant rejection in less than 10 min.

Hello,

We received your submission but do not have enough information to reactivate your listing currently. To reactivate your listing, provide any one of the following documents for proving the authenticity of your listings:
A. A letter of authorization or a licensing agreement from the rights owner demonstrating that you possess the right to use the content claimed. The documentation submitted must meet the following criteria:
– The document includes the name and address of the rights owner.
– The document includes your name and address, matching the information in your selling account.
– The document explicitly authorizes you to use the rights owner’s intellectual property with your own brand name.
B. A retraction from the rights owner to be sent to Amazon directly. You can find the contact information of the rights owner in the listing deactivation communication you have received.
C. Alternatively, modify your product detail page to ensure that it does not infringe on the trademark of the rights owner.

These are some examples of unacceptable terms:
– “Amazon Basics speaker charging cable.” Amazon Basics is a trademark by Amazon.
– “Wireless Amazon speaker for laptop.” Amazon is a trademark by Amazon.
– “Cable similar to Pinzon.” Pinzon is a trademark by Amazon, and we prohibit the use of “similar to.”

These are some examples of acceptable terms:
– “Cable for charging Amazon Basics speaker.” The cable is not created or sold by Amazon.
– “Wireless speaker for laptop, compatible with Amazon Basics.” The speaker is not created by Amazon.
– “Basic cable works with Pinzon.” The cable is not sold or created by Pinzon.

Has your listing been deactivated in error?
If you believe that there has been an error, tell us why. Your explanation should include how your listings have not violated the brand’s intellectual property along with documents mentioned earlier to support their authenticity.

How do I send this information?
If you are appealing an action we have taken on your listings for an intellectual property complaint, go to Received Intellectual Property Complaints in the Product Policy Compliance section on Account Health:
Amazon Sign-In _mpa

Locate the deactivation record for the product listings that you want to appeal and click on the Appeal button next to the record to submit your appeal to reactivate your listings. If you want to submit additional information, click on the “View appeal” button next to the deactivation record. To submit information necessary to reactivate your listings, click the “Submit additional information” button.

What happens if I do not send the requested information?
If we do not receive the required information, the listing will remain deactivated. The violation record will remain on your Account Health page for up to 180 days after the listing was deactivated or until the violation is addressed. Deleting your listing on this ASIN does not sufficiently address the reason for the violation and will not result in its removal from your Account Health page. Leaving this and other listing violations unaddressed may result in account deactivation.

Can you do this?

The email often comes after you have seen the violation in Account Health.
Did you look under Performance Notifications to see if the rights owner is listed in a notification there?

Nope
No tradmark infringed upon and no contact for the alleged rights owner.

I sent a pseudo threat with an explanation that I have contacted NAR’s legal department and they would like to know who is once again falsely representing them.

Now the appeal hasn’t been instantly rejected this time.

Had to post on the NSFE
https://sellercentral.amazon.com/seller-forums/discussions/t/9aea78c1-577a-4702-a418-bfb8d192e22c

Kept getting the same damn form letter:

You can find the contact information of the rights owner at the bottom of this message.

No no I can’t

Can you post a screenshot or copy of the original message they sent?

I never got the message I just saw the trademark violation. I copied and pasted the appeal word for word.

I’ve had several of these in the past. It’s probably not the trademark owner going after you, it’s probably a BOT that flagged something in your listing. Did you go to performance notifications and see a violation? I don’t remember the exact place but keep drilling down in that violation and you’ll see a screen that says exactly what the problem is. It’s probably something stupid and easy to change.

I’ve been hit in the past for using velcro which I though was a universal term but it is a brand. I just got hit a couple weeks ago for Wrangler as in Jeep Wrangler. It’s not how I used the word but the bots don’t know that and flagged it. Easier to just change the word to similar than fight with the bots.

Tried that.
I actually deleted the item because we stopped selling it. Too much competition and the item had expiration dates. The item was selling for $19 with free shipping, after all was said and done our profit was less than $1
I have unfortunately found that the things we sell with expiration dates tend to go bad before we can sell them so I started phasing them out.

3 emails to jeff
Submitting the same information 10x and someone with a brainstem finally resolved the issue.

Now I just have one where I have to convince them that there is no GTIN for another NAR product

All I can say is that every time you post you remind me I’m supposed to be buying these kinds of things.

@VitRhea Hit me up, let me know what you need.

It gets better, The violation was removed, the AH rating went kind of back up (208 instead of 212)

Then I get this

I swear these idiots don’t know what they are doing. 3 x the subject was “we have reinstated your item” followed by the form letter saying they didn’t

If enough monkeys send enough templated responses, eventually a seller will end up getting their .br marketplace deleted.

Well posted to the NSFE again.
A policy violation that kept changing and now anything I submit is automatically rejected in 1 min or less

Ugh, was it actually removed from your account and then it was re-added I assume? Or are they just sending this email even though it was removed from your account health already (in which case I would not reply back to it and let sleeping bears lie).

Different issues different items. Same Manufacturer.
I even have a violation for nothing that no one seems to be able to tell me what the violation is for
