Getting attacked and Amazon does nothing

So about 30-40 listings are now inactive due to FDA label compliance

The crazy thing is this is clearly an attack on our business by another competitor we are suing, as these ASINS are the only ones where he werent selling on

A clear example is the following:

The listing has item a 2 pack of it
listing b competitor sells on the same item but doesnt get taken down

i try to get it back up these listings showing the compliant label, but Amazon is just horrible and can’t understand anything

There are listings which are literally in full English with English packaging, and they still don’t reactivate it; they ask for a new asin to be created

It’s a clear pattern, I sell something it gets taken down if he is not selling on it

I even tried to show Amazon that variations of the listing (2 pack, one pack) are not being taken down, that he is selling on, and they just ignore me

It is absolutely insane, Amazon is a complete ■■■■ show of scammers getting away with damaging legit businesses

You give conflicting info as I read it, so which is it? Is he on them or not?

Without an example though it’s hard to say if Amazon is right or not.

Sounds like the OP is saying the listings where the competition is listed never get taken down, but the listings where they are not listed do get taken down?

I wouldn’t hold that against OP. It appears that English is not their first language. Pronouns are not universal to all languages.

So an example is:

Dust pan brand abc 2 pack
I sell gets taken down

Same dust pan 1 pack
He and i sell doesn’t get taken down

Remember that i am suing him for something else

Exception handling of any type has historically been non-existent during the holiday selling season for at least 15 years.

Between vacations and needs to fill in for those who are on vacations, many Amazon employee’s jobs are effectively unmanned.

Suggest you have your lawyers review whether they need to amend your lawsuit.

Amazon will not get it’s toe in legal issues between two sellers unless the court drags the into it kicking and screaming.

Generally don’t need a heavy burden of proof for a TRO. I mean if your in discovery time to ask for all emails related to Amazon from the defendant including but not limited to “Reporting of ASIN” or something like that. Call it out, get them to notice.

The main issue is Amazon

Amazon protects itself so much with the arbitration clause

They side with scammers, and you cant really do anything

once i get a judment i am going to try to show amazon clear evidence of infrignment and see if they do anything

So you’re suing the other party directly, which makes sense. Through arbitration Amazon will share all of 0 things with you. Been there. Done that.

yea what i am going to do is basically just force amazon to provide proof of stuff thru subpoena and get justice from the other party, justice from Amazon would be a dream but honestly only after all said is done i will look at everything and see if going after amazon would be worth it

they honestly need to be stopped somehow and break that arbitration clause

update started selling an item that weighs 135g and he sells the 40g version of it guess which listing was taken down due to FDA complaint lol

I am thinking of posting about all this in the old forum to see if any amazon mods actually do something idk at this point

Nope, they didnt do anything

Does anyone know what or how he could be reporting it? I am going to try to subpoena amazon for records and use it against him if possible?

Just as an aside. I don’t know what the guy is reporting but clearly you said he is a repeat offender. But I think your plan is solid legally. Sue the offending party and then subpoena Amazon for records. Because, in this case, it is not Amazon but the offending party that is causing the damage and then Amazon may be forced to play ball outside of arbitration leverage. It does seem costly but if you’ve somehow gamed the legal fees out - I would be interested in learning as time progresses of course and time permitting. All the best brother!

Amazon does respond to requests like this, or rather Amazon Legal responds. They can object but tend not to
