So about 30-40 listings are now inactive due to FDA label compliance
The crazy thing is this is clearly an attack on our business by another competitor we are suing, as these ASINS are the only ones where he werent selling on
A clear example is the following:
The listing has item a 2 pack of it
listing b competitor sells on the same item but doesnt get taken down
i try to get it back up these listings showing the compliant label, but Amazon is just horrible and can’t understand anything
There are listings which are literally in full English with English packaging, and they still don’t reactivate it; they ask for a new asin to be created
It’s a clear pattern, I sell something it gets taken down if he is not selling on it
I even tried to show Amazon that variations of the listing (2 pack, one pack) are not being taken down, that he is selling on, and they just ignore me
It is absolutely insane, Amazon is a complete ■■■■ show of scammers getting away with damaging legit businesses
Sounds like the OP is saying the listings where the competition is listed never get taken down, but the listings where they are not listed do get taken down?
Generally don’t need a heavy burden of proof for a TRO. I mean if your in discovery time to ask for all emails related to Amazon from the defendant including but not limited to “Reporting of ASIN” or something like that. Call it out, get them to notice.
yea what i am going to do is basically just force amazon to provide proof of stuff thru subpoena and get justice from the other party, justice from Amazon would be a dream but honestly only after all said is done i will look at everything and see if going after amazon would be worth it
they honestly need to be stopped somehow and break that arbitration clause
Just as an aside. I don’t know what the guy is reporting but clearly you said he is a repeat offender. But I think your plan is solid legally. Sue the offending party and then subpoena Amazon for records. Because, in this case, it is not Amazon but the offending party that is causing the damage and then Amazon may be forced to play ball outside of arbitration leverage. It does seem costly but if you’ve somehow gamed the legal fees out - I would be interested in learning as time progresses of course and time permitting. All the best brother!
